This Privacy Policy describes the types of personal information we may collect from you or that you may provide when you visit the website at www.fpxus.com (our “Website“) to obtain information about our service offerings or apply online through the Website for a revolving line of credit to finance vehicle inventory in your car dealership under our (“Floor Plan Agreement”) or use our Dealer Application (“Dealer App”) to manage your account and process payments both hereinafter the (“Services”). This Privacy Policy describes our practices for collecting, using, maintaining, protecting, and disclosing that information to others. This policy applies to information we collect:
  • On this Website.
  • In email, text, and other electronic messages between you and this Website.
  • When you enter your personal information to initiate the credit application process on this Website to enter into a Floor Plan Agreement.
  • To submit your completed credit application and obtain a credit report from our third party service provider.
  • When you download and utilize the features of the Dealer App.
  • When you log on to the Website portal for Dealers.
  • When you log on to the Website portal we maintain in order to access Auction information.
  • When you utilize our Website or Dealer App to make Automatic Clearing House payments to us in fulfillment of your Floor Plan Agreement.
  • When we conduct a background check through our third party service provider on you for underwriting purposes.
It does not apply to information collected by:
  • Us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Website

  • Usage Details. When you access and use the Dealer App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Dealer App.
  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

If you do not want us to collect this information do not download the App or delete it from your device.

You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

However, please know we do not currently sell data triggering that statute’s opt-out requirements.

We cannot delete your personal information except by also deleting your user account. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.
